These Terms and Conditions (this “Agreement”), which constitute is a legal agreement between you (“you&lrquo;) and The Lifebook Company, LLC, an Illinois limited liability company doing business as Lifebook, LifeBook and Mylifebookonline (collectively “Lifebook”), shall govern your participation in either Lifebook's web based program, My Lifebook Online or Lifebook's live in-person seminar program, (collectively “Lifebook Program”) and during the creation of your Lifebook. By checking any acceptance boxes or clicking any acceptance buttons, you (a) accept this Agreement and agree to be bound by each of its terms, and (b) represent and warrant to Lifebook that (i) you have the authority to enter into this Agreement, (ii) this Agreement is binding and enforceable against you, (iii) you have read and understand Lifebook's Privacy Policy (the “Privacy Policy&lrquo;), the terms of which are posted at Lifebook's website located at www.mylifebook.com (the “Website”) and incorporated herein by reference, and agree to abide by the Privacy Policy, and (iv) you have read and understand Lifebook's Terms of Use Agreement posted at the Website and incorporated herein by reference (the “Terms of Use”), and agree to abide by the Terms of Use.
Please read this Agreement carefully. If you do not agree to these Terms and Conditions or anything contained in this Agreement, in the Privacy Policy or in the Terms of Use do not participate in any Lifebook Program and you should immediately cease any and all activities on the Website and/or use of any services provided by Lifebook
Your Lifebook is a detailed, illustrated work book containing a vivid description of your ideal life and a detailed plan for its accomplishment. You will develop your Lifebook during the Lifebook Program, which may be completed in-person or online. For in-person Lifebook Programs, you will be led to create your Lifebook by a Lifebook Director who will utilize videos, leading questions, group discussion, quotes from famous people and other prompts to help you think through, clarify and articulate your own life vision. If you elect to complete your Lifebook Program online, the program will lead you through the process of creating your Lifebook. You'll be working on Lifebook's proprietary software as a template to create, organize and illustrate your life vision. During the Lifebook Program, we will deliver all the tools you need to successfully design your own Lifebook. We provide the process, the environment (for in-person sessions), the software, and all the instruction and direction necessary for you to create your own personal Lifebook; however, the finished product relies completely on the effort you bring to creating your Lifebook. You are the author of your Lifebook and its quality is totally dependent on you.
We are not professional counselors nor are we trained to provide any psychological counseling. The Lifebook Program is designed solely to facilitate your individual effort to create your own personal Lifebook and Lifebook's services are administrative and informational only. You hereby (a) acknowledge and agree that (i) neither Lifebook nor the Lifebook Program provide medical, psychological, legal or professional advice or counseling and (ii) LifeBook does not endorse the advice or thoughts provided by any participant at any forum or by any coach, facilitator or counselor and (b) waive and release Lifebook, Lifebook's licensors, subsidiaries, and affiliates and each of their respective past and present equity owners, directors, managers, members, shareholders, officers, employees, agents, contractors and representatives, successors and assigns (collectively, “Lifebook Releasees” and individually a “Lifebook Releasee”) from any medical, psychological or legal effects resulting from your attending or participating in the Lifebook Program (and no Lifebook Releasee shall be liable in any way from any such effects or any other liabilities arising out of any Lifebook Program).
The fees payable (including payment by credit card as provided in the Terms of Use) in connection with the Lifebook Program, together with our cancellation policy, are as set forth in this Agreement, in the Fees portion of the Website and in certain printed materials from time to time, any of which may be changed from time to time as provided in the Terms of Use.
For the in-person Lifebook Program, if for any reason you are unsatisfied with the Lifebook Program a refund will be available only on the final day of the in-person Lifebook Program. In order to receive a refund at the final day of the in-person Lifebook Program you must decline taking possession of the physical completed Lifebook that will be provided and also decline taking possession of any media that contain digital copies of your Lifebook. After declining acceptance of the Lifebook deliverables we will within a reasonable timeframe refund your payments made to Lifebook less a fee of $500. For the online Lifebook Program, if for any reason you are unsatisfied with the program prior to the earlier of 14 days after purchase or the initiation of the second online category, a full refund will be available to you.
We fully respect our members' right to privacy. By providing information to Lifebook, you agree to allow us to (a) utilize this information solely in administering the Lifebook Program, to disclose such information to our employees and contractors who participate, directly or indirectly, in administering the Lifebook Program and as otherwise provided in the Privacy Policy, and (b) transfer such information to a successor to the business of Lifebook provided such successor remains bound to protect the privacy of your information. Likewise, you agree that you will not divulge at any time private information learned during the in-person Lifebook Program about any participant in that in-person Lifebook Program.
You hereby acknowledge that each session participant, as a condition to attending a Lifebook Program, has made the same agreement and that Lifebook has no control over any disclosures made by participants outside of the in-person Lifebook Program. Accordingly, you waive and release the Lifebook Releasees from any against any claims or liabilities arising out of any other participant's actions or disclosures of your confidential information to any third party.
Lifebook's 12-category processes, environment, software, instruction materials and the Lifebook Program are valuable and unique assets of Lifebook prepared at great effort, time and expense. These processes and materials constitute trade secrets and proprietary information belonging to Lifebook and its affiliates. You agree not to record any portion of the Lifebook Program audio or video on any medium whatsoever, including cell phone, computer, video or camera or any audio recording device. You further agree that you will not at any time, during the Lifebook Program or at any time thereafter, use any confidential information or intellectual property of Lifebook for any purpose other than in connection with the preparation of your own personal Lifebook. Lifebook retains sole and exclusive ownership over all of its intellectual property, trade secrets and other confidential information, and nothing herein or otherwise grants any rights in such intellectual property to you other than a limited right to use such intellectual property solely in connection with creating your personal Lifebook.
